MATERNITY LEAVE
A pregnant employee must use all accrued annual and sick leave credits to minimize
the length of unpaid maternity leave. When all annual leave and sick leave are
exhausted, the employee is eligible for unpaid leave for the remainder of the twelve
(12) week workweek under the Family and Medical Leave Policy (FMLA).
Under the laws of the State of Tennessee, an employee who has been employed
full-time for at least twelve (12) consecutive months is entitled to up to four (4)
months of maternity. Family and Medical Leave taken as maternity will be counted
as part of these four months of maternity leave. If all applicable paid leave has been
exhausted, the remainder of the four (4) month maternity leave may be taken in an
unpaid leave status. During the additional fourth month of unpaid maternity leave
(after exhaustion of Family and Medical Leave), the employee must pay any health
care contributions to retain coverage.
A pregnant employee must report her pregnancy to her supervisor as soon as it is
confirmed. She shall supply a statement from her physician regarding the
approximate date of delivery and an appropriate date for beginning maternity leave
which factors shall be strongly considered by her supervisor in establishing a
beginning date for maternity leave. She must notify her supervisor immediately if
she or her physician determines a change in date is necessary.
The employee shall submit a certificate from her physician when returning from
maternity leave that she is physically able to fully assume the duties of her position.
