INTERSTATE SPEEDING
If you received a speeding ticket to this Court and can answer YES
to each of the following questions below, then that speeding violation
will not go on your driving record!
Was your ticket issued on the Interstate?
Did the Officer list the posted speed limit on your ticket as
55 MPH or more?
Did the Officer charge you with driving at a "speed"
of less than 75 MPH? (If you were driving a commercial vehicle,
the maximum speed for you to 'qualify' is 64, not 74.)
If you answered, "yes" to each of the above questions
This Court does not report such Citations for 'points' to the State
in accordance with Tennessee State Law.
Therefore the speeding charge will not put 'points'
on your driving record (MVR).
Therefore the speeding charge should not affect your insurance.
Therefore the speeding charge should not affect your employment.
Of course, you still have the option of coming to Court to contest
the charge if you believe yourself "Not Guilty." Just
be sure to understand that if you are coming to Court to keep
the 'points' off of your record
there is no need for that
on this type of speeding ticket.
For Your Information - Following are "facts of interest"
associated with this Interstate Speeding charge.
If you were cited for 69 MPH or less, you may pay $97.75 without
appearing in Court on this Interstate Speeding violation (if paid
in full by your scheduled Court Date). {And 'no points' will go
on your MVR.}
If you were cited for 70 to 74 MPH, you may pay $107.75 without
appearing in Court on this Interstate Speeding violation (if paid
in full by your scheduled Court Date). {And 'no points' will go
on your MVR.}
If you choose to appear in Court on this violation:
Regardless of whether you enter a plea of Guilty, Not Guilty,
or No Contest, and regardless of how the Judge rules on your
Case, 'no points' will go on your MVR as a result of this
Interstate Speeding violation!
If you enter a plea of Not Guilty to contest the speeding
charge:
The Judge will require a hearing trial just as with any
other Not Guilty Case. The Officer's testimony will be presented
first, and then you will have your opportunity to present
your testimony.
If the Judge rules in your favor (and finds you Not Guilty),
you will, of course, not be required to pay any Fines/Fees
on the Interstate Speeding violation and 'no points' will
go on your MVR.
If the Judge rules that you are Guilty, the amount due
on the Interstate Speeding violation will automatically
be $111.50 (if you were cited for 69 MPH or less; $122.50
if cited for 70 to 74 MPH). It is still true that 'no points'
will go on your MVR.
It is also true that the Judge still has the option to
offer you a form of Judicial Relief, which will most likely
be DIVERSION (Dismissed Upon Payment of Court Costs) if
you have a good driving record. (The Judge will also take
into consideration any mitigating facts regarding your case.)
That means you will pay $96.50 (regardless of what speed
you were cited), and 'no points' will go on your MVR.
If you enter a plea of Guilty or No Contest, you should
expect everything that is listed above in #3 and #4 for
Not Guilty. You will have an opportunity to speak with the
Judge to explain your case; but then he will enter a ruling
of Guilty. Of course, as noted in #4 above, the Judge may
offer you some form of Judicial Relief based on your driving
history and the facts of your case. And 'no points' will
go on your MVR.
