APPEALS

CITATIONS

If you are dissatisfied with the Judge's ruling on your case, you may Appeal to have a completely new trial (with or without a jury) at Circuit Court in the City/County Building.

  • Appeal must be filed at City Court within 10 days of the Judge's ruling on your case.

  • A $134.50 Appeal Fee must be paid at the time of the filing. (This fee is paid to City Court; City Court then pays the fee to Circuit Court when filing the Appeal.)

  • Circuit Court requires you to post a $250 Cash Appearance Bond through City Court… Your Bond options include:
      1. You may deposit $250 with City Court as a Cash Appearance Bond. City Court will transfer this deposit to Circuit Court and once your Case is over, you will receive a refund of the $250, less any Fines/Fees due the Court (if any).

      2. Or, your Attorney can sign a signature Bond on your behalf.

      3. Or, you may purchase a Surety Bond through a Bonding Company.

  • Circuit Court will schedule your new court date once they receive all of the paperwork from City Court.

  • Once the Case is turned over to Circuit Court, City Court is no longer involved. However, if the City Court Judge’s decision is upheld by Circuit Court, you will be required to pay the original Fines/Fees to City Court just as you were instructed prior your Appeal.

  • Because there are many legal questions associated with an Appeal, hiring a lawyer is suggested.
